Kratom law in the United States is set largely at the state level, with a patchwork of local city and county rules on top. A handful of states ban kratom outright; others have passed a Kratom Consumer Protection Act (KCPA) that keeps it legal for adults under rules on age, labeling, and retail; the rest have no statewide framework at all.

Where kratom is regulated, sales are generally restricted to adults 21 and older, and products must be labeled and tested. Federally, kratom is neither scheduled for botanical use nor FDA-approved as a drug, supplement, or food additive — and concentrated 7-hydroxymitragynine products have drawn separate scheduling action.

Because these laws change and local rules can be stricter than the state, always confirm the current position before buying or selling. We mark anything we cannot verify against a primary source.
